Payments and refunds policy

INTRODUCTION

By accepting the general Terms and Conditions of this website, every user by default accepts this Payments and Refunds policy.

A reservation is considered "placed" as soon as the user clicks on the Confirm button on the checkout page and receives a confirmation of the reservation either on a Reservation successful page, or via email. Before clicking on the Confirm button, the user is reminded to read this Payments and Refunds policy, indicating it ticking a confirmation checkbox.

A request for a reservation is not considered a reservation as such.

PAYMENTS BETWEEN USERS

Payments for reservations made between users will only involve the respective users. Users can agree to settle a payment using any payment method, even those not displayed on this website.

Scapada takes no part in payments between users, as those occur outside of our platform. We charge no fees or commissions when payments occur or reservations are placed between users. This implies as well that we are not responsible for any setbacks during the payment phase, but we will always offer assistance where requested and possible.

Under no circumstances will Scapada be liable for the loss of funds of a user of this website. Some examples that can lead to a loss of funds are, among others:

  • A user sending funds to a wrong bank account (or any sort of account)
  • A user (administrator) who receives funds from another user and doesn't provide what is indicated on his listing
  • The failure of the user's software (payment apps, browsers, etc...)
  • Any institution (banks, financial companies, etc...) blocking or freezing the payment
  • Failures in our system that could lead to displaying erroneous payment data. Although an improbable case, users are urged to verify that all payment data is correct before making a payment

In case a payment page is not being displayed, or erroneous payment data (such as amounts and account numbers) is shown, please contact us.

PAYMENTS TO SCAPADA

Scapada may require payments for subscriptions, for the placement of featured listings, and for other types of functionality added to the normal behavior of the system. These payments are private and non-refundable, except in the cases mentioned in the section titled Cancellations and Refunds.

CANCELLATIONS AND REFUNDS

In exceptional circumstances we might issue a refund if there is good reason to believe that the user unintentionally paid for the wrong product, or if the user overpaid the product for any reason. Any fees charged by banks or apps for the reimbursement process will be communicated to the user and will always be covered by the user. In case of overpayment, only the difference (minus fees) will be reimbursed.

Under no circumstances will refunds be issued if we decide to close a user account for violating our Terms and Conditions, of which this policy is a part of.

Refunds between users after a reservation has been made and paid for will be dealt with according to the listing’s refunds policy indicated by its administrator, if any. Scapada is not responsible for any refunds between users. If the listing's administrator does not provide a cancellations and/or refunds policy for a listing, then no rules apply to cancel or refund reservations, and thus forces both parties to reach an agreement.

The cancellations and refunds policy stated by the listing’s administrator becomes binding upon placing a reservation. This means that the parties involved agree to its terms, and in case any party does not follow the policy, the other party may initiate legal action.

The administrator of the listing may change its cancellations and refunds policy at any time, but the changes will be valid only for reservations placed after the changes. Reservations placed earlier will still be bound to the previous policy, which should be available in written form in the original confirmation emails sent to both parties.

DISPUTES

In case of disputes among users about payments, we reserve the right to use any data we might have related to those users and the respective reservations.

If one of the users in the dispute initiates legal action and there are indications of possible wrongdoings, we may offer the aforementioned data to anyone who requests it if this would facilitate the resolution of the dispute.
